Defects in the submission in respect of the extension of the validity period

General procedure

If the submission contains defects, the trade licensing office will send the submitter a Request for rectification of deficiencies in which it will:

  • Identify the defective submission
  • Specify the defect contained in the submission
  • Indicate how the defect in the submission can be rectified – e.g. by providing any missing information, presenting the relevant document, etc.
  • Specify a time limit for rectifying the deficiencies
  • Advise the applicant of what will happen if the defect in the submission is not rectified
Specific procedure for a foreign natural person

If a foreign natural person fails to attach a new residence permit for the Czech Republic, the trade licensing office will send the submitter a Request for rectification of deficiencies in which it will:

  • Identify the defective submission
  • Specify the defect contained in the submission
  • Request that proof of a new residence permit for the Czech Republic be submitted
  • Specify a reasonable time limit to do so, at least for the period of residence that has already been permitted
  • Advise the applicant of what will happen if the permit is not submitted

At the same time, it will register in the trade licensing register the new limitation of validity of the trade authorisation that corresponds to the end of the time limit specified for submitting proof of a new residence permit for the Czech Republic. The time limit specified for submitting proof of a new residence permit cannot be extended even at the entrepreneur’s request and, unless proof of the residence permit is submitted, the trade authorisation terminates as of the last day of this time limit.

After that, the procedure followed by the office depends on whether the defect has been rectified.
