LEGAL PERSON (Czech)

A legal person for which the law requires compulsory registration in a public register for its creation may make a submission in respect of the notification of a trade or an application for a concession at any time after its creation.

If a legal person has only been established but has not yet been created, i.e. its registration in a public register has not been made, such a submission may be made by its founders or by the bodies or persons authorised to submit an application for the registration of the legal person in the public register. The scheme for the creation of a trade authorisation is then tied to the creation of the legal person.

For a legal person that has already been created, i.e. registered in a public register, the notification of a trade or an application for a concession is submitted by its statutory body or, if relevant, members of its statutory. A submission on behalf of the legal person may also be made by another person who has been authorised to do so in writing by the legal person’s statutory body. In accordance with the Trade Licensing Act, a trade authorisation is then created as of the date of notification in the case of notifiable trades, and as of the date on which the decision granting the concession enters into force in the case of permitted trades.
