The founders of a legal person (or, where applicable, the bodies or persons authorised to submit an application for the registration of the legal person in a public register) that is created by registration in a public register but has not yet been registered, may submit the notification of a trade or an application for a concession, on the basis of which the trade licensing office will confirm that they meet the conditions for carrying on a trade by issuing an extract from the trade licensing register. A responsible representative appointed by an entrepreneur must meet the general (Section 6 of the Trade Licensing Act) and specific conditions for carrying on the trade, i.e. professional or other competence, if required by law (Section 7 of the Trade Licensing Act). The entrepreneur (and their responsible representative) must not be subject to any impediments to carrying on the trade (Section 8 or, if relevant, Section 8a of the Trade Licensing Act), and other conditions specified in the Trade Licensing Act must be met.
