Penalties for carrying on a notifiable trade without a trade authorisation

Offences by natural persons

Pursuant to Section 61(2) of the Trade Licensing Act, a natural person commits an offence by submitting a false solemn declaration concerning good character in accordance with the relevant provision of Section 46(1) of the Trade Licensing Act.

Pursuant to Section 61(3) of the Trade Licensing Act, a natural person commits an offence by:

  • Carrying on a trade which is an unqualified trade without holding a trade authorisation for that trade
  • Carrying on a trade which is the subject of a vocational or professional trade without holding a trade authorisation for that trade

Pursuant to Section 61(4) of the Trade Licensing Act, the following fines may be imposed on anyone who commits one of the above offences:

  • A fine of up to CZK 100 000 for submitting a false solemn declaration concerning good character
  • A fine of up to CZK 500 000 for carrying on unauthorised business activity that is classified as an unqualified trade
  • A fine of up to CZK 750 000 for carrying on unauthorised business activity that is the subject of a vocational trade or a professional trade.
Offences by legal persons

Pursuant to Section 63(1) of the Trade Licensing Act, a legal person commits an offence by:

  • Carrying on a trade which is an unqualified trade without holding a trade authorisation for that trade
  • Carrying on a trade which is the subject of a vocational or professional trade without holding a trade authorisation for that trade

Pursuant to Section 63(2) of the Trade Licensing Act, the following fines may be imposed on a legal person that commits one of the above offences:

  • A fine of up to CZK 500 000 for carrying on unauthorised business activity that is classified as an unqualified trade
  • A fine of up to CZK 750 000 for carrying on unauthorised business activity that is the subject of a vocational trade or a professional trade.
