Processing of submissions without defects

If the submission is free of defects or any defects in the submission have been rectified, the trade licensing office will deal with submissions in respect of the notification of a trade in accordance with Section 47(1) of the Trade Licensing Act:

  • It will make registration in the trade licensing register within 5 working days.
  • It will issue the entrepreneur an extract from the trade licensing register containing information pursuant to Section 47 of the Trade Licensing Act, which is proof of trade authorisation.
  • It will issue the entrepreneur any other documents required by law (e.g., Notification of the registration of an establishment in the trade licensing register, Notification of the registration of the interruption of a trade in the trade licensing register, etc.).

The result of the entrepreneur’s submission in respect of the notification of a trade is thus the registration of information on the entrepreneur and their trades in the trade licensing register, which is also notified to other public administration authorities in accordance with the Trade Licensing Act. With the exception of the information listed in the Act (Section 60(3) of the Trade Licensing Act), any information that is registered in the trade licensing register is part of the public section of the trade licensing register.

Once the registration in the trade licensing register is made, the entrepreneur is issued an Extract from the trade licensing register.

An extract from the trade licensing register for a natural person includes:
  • Given name and surname, academic title or scientific degree
  • Birth registration number, if assigned
  • Date of birth of the entrepreneur
  • The address of the entrepreneur, for a foreign person the address of domicile outside the Czech Republic and the address of residence in the Czech Republic, if permitted
  • The designation and address of the branch plant in the Czech Republic, if set up
  • Company name, if the natural person is registered in the commercial register
  • Personal identification number, if assigned
  • The objects of business in full or in part in accordance with Section 45(4) of the Trade Licensing Act, and any other supplementary information relating to the scope of the trade authorisation, if specified by the entrepreneur in the notification (e.g. the fields of unqualified trade activities)
  • The address of the registered office
  • The validity period of the trade authorisation; in the case of a person who is subject to the obligation to have a residence permit under Section 5(5) of the Trade Licensing Act, this period is deemed to be the period of residence permitted
  • The date of inception of the trade authorisation – it may be indicated as a specific date or, if it is tied to the fulfilment of other conditions, as a verbal description of the fulfilment of the condition necessary for the inception of the trade authorisation
  • The date and place of issue of the extract
An extract from the trade licensing register for a legal person includes:
  • Company name, business name
  • The address of the registered office
  • Personal identification number, if assigned
  • In the case of a foreign person, the designation and address of the branch plant in the Czech Republic
  • The objects of business in full or in part in accordance with Section 45(4) of the Trade Licensing Act, and any other supplementary information relating to the scope of the trade authorisation, if specified by the entrepreneur in the notification (e.g. the fields of unqualified trade activities)
  • The validity period of the trade authorisation
  • The date of inception of the trade authorisation – it may be indicated as a specific date or, if it is tied to the fulfilment of other conditions, as a verbal description of the fulfilment of the condition necessary for the inception of the trade authorisation
  • The date and place of issue of the extract

Any other documents that may be issued contain the information specified in the relevant provision of the Trade Licensing Act, and additional information on such documents is provided in the corresponding sections of the Guide.

Definition of the moment of the inception of trade authorisation for a notifiable trade
A foreign natural person

If a foreign person is subject to the obligation to have their residence permitted in the Czech Republic in order to carry on a trade, and a document proving the granting of a visa for a stay of more than 90 days or a document proving a long-term residence permit has not been attached to the notification of a trade upon submission, the inception of the trade authorisation is tied to the date of presenting the relevant document proving a residence permit for the Czech Republic.

A foreign (natural or legal) person intending to carry on a trade in the Czech Republic through a branch plant

If the branch plant of a foreign person is not yet registered in the commercial register at the time of the notification of a trade, the inception of the trade authorisation is tied to the date of registration of the branch plant in the commercial register, provided that the application for registration in the commercial register must be submitted within 90 days from the date of delivery of the extract from the trade licensing register.

Legal person created by registration in a public register (not yet registered)

If a legal person whose creation is tied to its registration in a public register is not yet registered in such a register at the time of the notification of a trade, the inception of the trade authorisation is tied to the date of registration of the legal person in the relevant public register, provided that the application for registration in the relevant public register must be submitted within 90 days from the date of delivery of the extract from the trade licensing register.


In all other cases, the trade authorisation for the notifiable trade commences on the date of notification.

Failure to meet a condition to which the inception of a trade authorisation is tied

If the entrepreneur fails to meet the above condition required for the inception of a trade authorisation, the trade licensing office will make a decision to the effect that the notifier has not met the conditions for the inception of a trade authorisation and will register this fact in the trade licensing register.
