Final decision to grant a concession

If the decision to grant a concession has come in to force, the trade licensing office will complete the proceedings in respect of the application for a concession in accordance with Section 54(1) of the Trade Licensing Act:

  • Within 5 working days from the date of entry into force of the decision to grant a concession, it will make a registration in the trade licensing register
  • It will issue the entrepreneur an extract from the trade licensing register containing information pursuant to Section 47 of the Trade Licensing Act, which is proof of trade authorisation
  • It will issue the entrepreneur any other documents required by law (e.g., Notification of the registration of an establishment in the trade licensing register, Notification of the registration of the interruption of a trade in the trade licensing register, etc.)

The result of the entrepreneur’s submission in respect of an application for a concession is thus the decision to grant a concession that has come into force and the subsequent registration of information on the entrepreneur and their trades in the trade licensing register, which is also notified to other public administration authorities in accordance with the Trade Licensing Act. With the exception of the information listed in the Act (Section 60(3) of the Trade Licensing Act), any information that is registered in the trade licensing register is part of the public section of the trade licensing register.

Once the registration in the trade licensing register is made, the entrepreneur is issued an Extract from the trade licensing register.

An extract from the trade licensing register for a natural person includes:
  • Given name and surname, academic title or scientific degree
  • Birth registration number, if assigned
  • Date of birth of the entrepreneur
  • The address of the entrepreneur, for a foreign person the address of domicile outside the Czech Republic and the address of residence in the Czech Republic, if permitted
  • The designation and address of the branch plant in the Czech Republic, if set up
  • Company name, if the natural person is registered in the commercial register
  • Personal identification number, if assigned
  • The objects of business in full or in part
  • The address of the registered office
  • The validity period of the trade authorisation; in the case of a person who is subject to the obligation to have a residence permit under Section 5(5) of the Trade Licensing Act, this period is deemed to be the period of residence permitted
  • The date of inception of the trade authorisation – it may be indicated as a specific date or, if it is tied to the fulfilment of other conditions, as a verbal description of the fulfilment of the condition necessary for the inception of the trade authorisation
  • The date and place of issue of the extract
An extract from the trade licensing register for a legal person includes:
  • Company name, business name
  • The address of the registered office
  • Personal identification number, if assigned
  • In the case of a foreign person, the designation and address of the branch plant in the Czech Republic
  • The objects of business in full or in part
  • The validity period of the trade authorisation
  • The date of inception of the trade authorisation – it may be indicated as a specific date or, if it is tied to the fulfilment of other conditions, as a verbal description of the fulfilment of the condition necessary for the inception of the trade authorisation
  • The date and place of issue of the extract

Any other documents that may be issued contain the information specified in the relevant provision of the Trade Licensing Act, and additional information on such documents is provided in the corresponding sections of the Guide.

Failure to meet a condition to which the inception of a trade authorisation is tied

If the entrepreneur subsequently fails to meet the condition necessary for the creation of a trade authorisation – in the case of a foreign natural person this may be the submission of a proof of residence permit within the time limit set out in Section 47(8) of the Trade Licensing Act, and in the case of a legal person created by registration in a public register or a branch plant of a foreign person this may be the submission of an application for registration in the relevant public register within 90 days from the date of delivery of an extract from the trade licensing register – the trade licensing office will note this fact in the file and register it in the trade licensing register.
